1. Acceptance of Terms

By accessing or using TechUpServices.in ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all visitors, users, and businesses that access or use the Platform.

2. Description of Service

TechUpServices.in provides a WhatsApp automation platform that enables businesses to:

  • Send and receive WhatsApp messages through the WhatsApp Business API
  • Manage contacts and conversation history
  • Create and send broadcast campaigns
  • Build automated conversation flows and chatbots
  • Track message delivery, read receipts, and engagement analytics
  • Manage message templates approved by Meta

3. Eligibility

You must be at least 18 years old and have the legal authority to bind your business to these Terms. By using the Platform, you represent and warrant that you meet these requirements.

4. Account Registration

To use the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use
  • Accept responsibility for all activities under your account

5. Acceptable Use Policy

You agree NOT to use the Platform to:

  • Send spam, unsolicited bulk messages, or content that violates WhatsApp's Commerce Policy
  • Transmit malware, viruses, or any harmful code
  • Harass, abuse, threaten, or harm another person
  • Violate any applicable local, state, national, or international law
  • Attempt to gain unauthorized access to the Platform or other accounts
  • Use the Platform for any fraudulent or deceptive purpose
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Send messages that contain hate speech, discrimination, or illegal content

6. WhatsApp Business API Compliance

Your use of the Platform is subject to Meta's policies, including but not limited to:

  • WhatsApp Business Policy
  • WhatsApp Commerce Policy
  • WhatsApp Business API Terms of Service
  • Meta Platform Terms of Service

You are solely responsible for ensuring your use of WhatsApp messaging complies with all applicable Meta policies and local regulations. We reserve the right to suspend your account if we determine you are violating these policies.

7. Subscription and Billing

The Platform offers paid subscription plans with the following terms:

  • Fees are billed in advance on a monthly basis
  • Subscription auto-renews unless cancelled before the renewal date
  • Fees are non-refundable for the current billing period
  • We may change pricing with 30 days' notice
  • WhatsApp conversation charges from Meta are billed separately by Meta

8. Intellectual Property

The Platform, including its design, code, logos, and content, is owned by TechUpServices.in and protected by intellectual property laws. You retain ownership of your data, contacts, and message content. We grant you a limited, non-exclusive, non-transferable license to use the Platform for your business purposes.

9. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our data practices as described in the Privacy Policy.

10. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. The Platform may be unavailable during maintenance windows or due to factors beyond our control, including Meta API outages. We are not liable for any losses resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, TechUpServices.in shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless TechUpServices.in from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or violation of any third-party rights including Meta's policies.

13. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms or Meta's policies
  • Non-payment of subscription fees
  • Fraudulent or illegal activity
  • Request by law enforcement or government agencies

Upon termination, your right to use the Platform ceases immediately. We will retain your data as described in our Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation or, if necessary, through binding arbitration.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the new Terms.
